Steun Dental General Terms & Conditions

Effective January 1, 2025

Steun Dental is a commercial name for services and products provided by a registered company under the name of Fernandez & Garro B.V. (hereafter only referred as Steun Dental) which consists of a private limited liability company the offers services and products to dental professionals around the world.

These General Terms and Conditions shall apply to every assignment granted to Steun Dental, including every follow-up assignment or altered or supplementary assignment. All provisions contained in these terms and conditions have been drawn up also for the employees of Steun Dental and anyone involved in the execution of the contract and/or anyone who could be liable in that connection.

All assignments shall be deemed to have been exclusively granted to and accepted by Steun Dental, even assignments that are expressly or tacitly intended to be executed by a specific person. The partners and other persons working for Steun Dental are neither personally bound nor personally liable.

Steun Dental will always exercise due care in engaging third parties. However Steun Dental is not liable for the failure of such parties to perform. Steun Dental has been authorized by the client to accept on the client's behalf any limitations of liability of such parties. If reasonably possible, Steun Dental will consult with the client about engaging a third party. The duty of consultation will not apply at any rate to the engagement of translators, couriers, bailiffs and attorneys of record.

Assignments granted to Steun Dental shall be executed exclusively for the benefit of the client. Third parties shall not be able to derive any rights from the content of the work carried out, nor more generally from the manner in which such assignments have or have not been executed.

Steun Dental, but any and all persons – including those who are associated with Steun Dental in any capacity, as well as third parties – who are engaged in the execution of an assignment granted by a client shall be entitled to appeal to these General Terms and Conditions.

Steun Dental Does Not Provide Health Care Advice or Services. You acknowledge and agree that:
(i) Steun Dental does not practice medicine and does not offer health care services;
(ii) All services, processes, plans, forms, reports, reference materials, or any form of communication may contain errors or omissions, are not intended to provide medical advice, and should not replace professional clinical judgment;
(iii) You are solely responsible for delivering all dental and health care services to Patients when utilizing our Products and Services;
(iv) Steun Dental is not, and will not be, accountable for any health care decisions you make regarding the use of Steun Dental’s Products or Services; and
(v) Without limiting the above, a qualified and licensed dental professional will oversee and review all health care data and personal information stored on our Services, coordinate and manage all medical treatment, and consistently apply their clinical judgment in any medical situation or treatment while assessing associated clinical risks.

Service Level Agreement (SLA). Treatment Planning Services for Invisalign, Angel Aligner and Spark cases, take between 2-5 business days. Depending on the complexity of the case, which will require more work on the case and subject to delays from any clear aligners lab, the turnaround time may take more days.

Special Offers and Promotions. Any special offer or promotion of services will apply only to the same product/service line. This applies to any promotion or offer such as 5 packs at 5% discount, 10 Packs at 10% discount or any other special offer. For example, by purchasing a 5 Pack Promotion at 5% discount for Steun Basic, it will include 5 Steun Basic cases at 5% discount (not a mix of other services like Steun Plus or Steun Premium). In such case you will be purchasing 5 “Steun Basic” cases with the terms & conditions of Steun Basic. For example, by purchasing a 10 Pack at 10% discount of Steun Premium you will be purchasing 10 “Steun Premium” cases at 10% discount with its own terms & conditions and not a mix of services and products. This applies to any and all of our services unless expressively indicated otherwise by Steun Dental’s Management Team.

Data Protection; Personal Information. You affirm and guarantee that you have obtained all necessary rights to any personal data, including patient and health care information, allowing us to collect, use, and share such data in connection with providing Products and Services in accordance with our Privacy Policy and GDPA. You confirm that our use of this information does not infringe upon any intellectual property rights, privacy rights, or any other third-party rights. You agree to indemnify, defend, and hold harmless Steun Dental, along with its successors and assigns, from any losses, liabilities, costs, claims, or expenses arising from or related to a breach of this Agreement, including this section and the Global Protection Addendum. Upon termination or expiration of the Agreement, Steun Dental will delete, close, or (if you choose) return all Patient Data in its possession, except where applicable laws require retention of some or all such data.

Non-obligation to process an order. Steun Dental has the right, based on the analysis of the records, to not to proceed to do the treatment plan and recommend against proceeding to treat the patient’s case with clear aligners. Examples might consider, but not limited to: Skeletal cases that requires surgery, severe periodontal conditions, diseases and conditions visible in the digital records, lack of records to do an appropriate diagnosis and treatment plan. In such situations in which Steun Dental determines not to plan the case, Steun Dental also has the right to charge for the complete fee of the services considering that a full analysis took place and that the value of the service is also to assess customers in potential complications based on the digital aspects of the orthodontic plan. 

AI-Diagnostic Driven Treatment Planning Services. Treatment Plans based on AI-analysis done over the set of patient’s orthodontic records. Quality and precision of the AI-analysis is determined by the quality and availability of the orthodontic records provided by the treating doctor.

Refinements. Services in which refinements are included, such refinements will only be valid as long as the case is not closed by the clear aligner lab (Invisalign, Spark, Angel Aligner and others). Once the case is expired or closed by the clear aligner company Steun Dental has no obligation to fulfill the service.

Tax fees on services. Although tax fees might not be applicable in some countries or regions or might vary from in each country or region. Steun Dental has the right, at any point in time, to apply tax fees to its services. Such tax fees will be applicable over the listing price of the service and not included in the listing price.

Steun Dental right to protect its patron and business. Steun Dental has the right to not to refuse a service or product to a customer and to turn away a customer if in any way it determines that the customer or potential customer is or can be harmful to Steun Dental’s patron, business or any other area of the company.

Right to modify, update, or discontinue any products or services. The Company reserves the right to modify, update, or discontinue any products or services at any time, without prior notice. Such changes may be made to reflect business needs, regulatory requirements, technological advancements, or other factors. The Company shall not be liable for any consequences arising from such modifications, updates, or discontinuations. Continued use of our products and services following any changes constitutes acceptance of those changes.

Promotions Terms & Conditions – Steun Dental

These Promotion Terms & Conditions ("Terms") apply to all promotional offers, discounts, and incentives (“Promotions”) made available by Steun Dental via its website or other communication channels, unless explicitly stated otherwise.

1. Eligibility

Promotions are generally open to all customers unless specified otherwise. Steun Dental reserves the right to limit participation in certain Promotions based on factors such as customer location, purchase history, or other eligibility criteria.

2. Promotion Duration

Promotions may be valid for a limited time only or on an ongoing basis. Each Promotion will specify its start and end dates, where applicable. Steun Dental is not obligated to extend or repeat any expired Promotion.

3. Redemption

To redeem a Promotion, customers must visit www.steundental.com and complete a purchase in accordance with the instructions specified in the promotional material. Promotions may require a promotional code or be automatically applied at checkout.

4. Exclusions

Promotions may not apply to all products or services. Certain items, including but not limited to custom services, previously discounted products, or special packages, may be excluded at Steun Dental’s discretion. Please review the specific terms of each Promotion for more details.

5. Non-Transferability & No Cash Value

Promotions are non-transferable, not redeemable for cash, and may not be combined with other offers unless expressly permitted.

6. Right to Modify or Cancel

Steun Dental reserves the right to cancel, modify, or suspend any Promotion at any time without prior notice, for any reason including but not limited to technical issues, fraud, or circumstances beyond its control.

7. Misuse of Promotions

Steun Dental reserves the right to withhold or cancel Promotions in cases of suspected abuse or fraud, including the creation of multiple accounts to take advantage of offers.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction of Steun Dental's primary place of business, without regard to conflict of law principles.
